Payment of your deposit represents your acceptance of the following terms and conditions, as well as all General Information listed on the website and subsequent trip departure material: Mistral Experiences; its members; employees and agents, give notice that all services and arrangements related to this tour have been made by Mistral Experiences only as agents upon the express condition that Mistral Experiences shall not be liable and does not assume responsibility for any claims, damages, expenses or other financial loss whether to person or property arising out of any injury, accident, death, cancellation, delay, alteration, or inconvenience resulting from any act of omission, commission or inadvertence of any hotel, carrier, restaurant or other company or person rendering any of the services included in the tour or caused by weather, sickness, strikes, quarantines or the willful or negligent acts of any other tour members or any cause whatsoever beyond the control of Mistral Experiences.
As soon as we receive your reservation and deposit, we will send you detailed information on what to bring, how to prepare for your trip, travel directions, detailed itinerary, pre- and post-tour hotel information and Mistral Experiences policies.
You are responsible for reading the pre-trip information material and bringing with you all of the appropriate clothing and equipment, as well as acting in accordance with the customs and laws of the regions visited. Mistral Experiences reserves the right to accept, remove, retain or decline any trip member at any time for any reason. In such case, a refund equal to the actual cost of the unused services is the limit of Mistral Experiences responsibility.
Some days or activities and certain trips listed may be operated by local tour operators contracted with Mistral Experiences. These operators have been selected for the quality of the services and tours they offer as well as the desirability of the destinations. Where trip notes and detailed pre-departure information is provided for your trip, all the information contained therein will be deemed to be part of the contract. This information is available from our website or by mail upon request. These documents contain up-to-date definitive information about the itinerary and travel arrangements. Should there be a discrepancy between the information in the brochure or website and the trip notes and pre-departure information, the information in the trip notes and pre-departure information will be considered the most up-to-date and accurate.
First class accommodations that reflect the region visited or nature of the tour (double occupancy). A $500 supplement will be charged for a private room. We will match solo travellers upon request where possible.
Meals as per the itinerary (please see specific trip information).
Selected beverages including bottled water and wine as selected by your hosts (please see specific trip information).
Scheduled admission fees to all attractions included in the itinerary.
All gratuities for included meals.
24/7 access to your experienced hosts during the tour.
All transportation during the trip, whether by bus, boat, train, plane, cable car or funicular (unless otherwise noted) including pick-up/drop off at designated points on the itinerary and the airport or TVG station.
For all-inclusive tours, all-inclusive refers to all meals, beverages, gratuities, accommodation, transportation and travel sites as selected by your hosts and outlined in the detailed travel guide provided.
Air and land transportation to and from the trip arrival and departure location (please see specific trip information).
Meals and Beverages not listed in the tour package will be at your own expense.
Personal Expenses including but not limited to phone calls/gifts and other incidentals.
Non-scheduled visits and activities.
We will consider special requests such as special dietary requests or, specific rooming requirements, when you book. We will tell you whether there is a charge for the request. We can only guarantee requests for which there is a charge, or those that are confirmed in writing.
A deposit of $500 (CAD) per person is required to reserve any tour experience.
The balance of the trip price is due 90 days prior to departure, payable by check or bank transfer. If the balance is not paid when due, Mistral Experiences reserves the right to regard the reservation as canceled.
If the guest cancels or changes the booking
If, after our confirmation has been issued, you (i) make a change to your existing booking, we may charge an amendment fee of $100 (CAD) per booking for each change or (ii) wish to change to another of our tours or change departure date, we will try to make the changes subject to availability, provided that notification is received in writing at our offices from the lead name at least 56 days before departure and you may be charged $100 (CAD) per person to cover our administration costs.
In addition to the fee we charge, any alteration, whether a change to an existing booking or a change to another tour or departure date, will also be subject to payment by you of any costs imposed by any of the suppliers providing the component parts of the tour. If the holiday to which you transfer is more expensive than the one you originally booked, a further deposit may also be payable. Any alteration by you within 56 days of departure will be treated as a cancellation of the original booking and may be subject to cancellation charges.
Where you are unable to travel you can transfer your booking to another person, subject to the following:
a) you must notify us in writing at least 30 days before departure; and
b) your request is accompanied by all original travel documents which you have received and the full name and address of the transferee; and
c) the transferee must fulfil any conditions that apply to the booking, including complying with these Booking Conditions; and
d) payment by you of an administrative charge of a minimum of $50 (CAD) per person plus payment of all costs charged or levied by those supplying your travel arrangements.
Both the transferor and transferee will be jointly and severally liable for payment of the trip price and other associated expenses.
You, or any member of your party, may cancel your tour at any time providing that the cancelation is made by the lead name in writing. Notice of cancelation will be effective upon receipt of your written communication. As we start to incur costs from the time the contract is confirmed we will retain your deposit and in addition will apply other cancelation charges as shown below.
Where written notification of the cancelation is received:
•91 days or more prior to departure – Loss of Deposit
•Between 46 and 90 days of the departure – loss of 50% of total booking
•31-45 days of the departure-loss of 75% of total booking
•30 days and less prior to departure – we will retain 100% paid by you in connection with the booking.
Please note that for certain travel arrangements e.g. many scheduled transport providers, the cancelation charge may be higher than those shown. In certain cases a 100% cancelation fee applies as soon as the booking is made and the ticket is issued. This is especially true when booking a tailor-made itinerary. Please ask for full details of cancelation charges at time of booking. We strongly recommend you to take out insurance that includes cover against irrecoverable cancelation costs. Additionally, you will remain responsible for the full amount of your insurance premium and this will not be refunded in the event of your cancelation. You may however be able to transfer this cover to another trip. All communications relating to this contract (in particular any requests to cancel or amend your travel arrangements) must be from the Lead Name in writing and in English or French and delivered by email to firstname.lastname@example.org or sent by registered mail to Mistral Experiences, 20 Ashley Rd, Chelsea, Qc, J9B 1W9 .
If Mistral Experiences changes or cancels the booking
We reserve the right to cancel your booking or change any of the facilities, services or prices described in our brochures or website. We will endeavour to advise you of any changes known at the time of booking.
We plan the arrangements for your tour many months in advance and may occasionally have to make changes, most of which are minor. If a major change becomes necessary, we will advise you of the change as soon as possible. Whether a change is ‘major’ depends on the nature of the tour and may include, for example only, a change in accommodation. When a major change occurs, you will have the choice of either accepting the change, or accepting a replacement tour from us of equivalent or closely similar standard and price, or cancelling your tour. In such an instance, we will refund all payments received, which will constitute full settlement.
Operation of all tours is dependent on a minimum number of persons booking the tour. If that number is not achieved, we reserve the right to cancel the tour. In such an instance, we will refund all payments received, which will constitute full settlement.
In no circumstances will we cancel your tour less than 56 days before the scheduled departure date except for reasons of late cancelations from other passengers on your departure, force majeure (as defined below) or failure on your part to pay the final balance.
We strongly recommend that you make no travel arrangements to your point of departure, make any connecting travel that is non-refundable or non-changeable or incurs penalties or incur any costs in respect of visas or vaccinations until such time as your travel itinerary has been confirmed. If you make such arrangements which you are then unable to use due to a change in your itinerary we shall not be liable to you for the cost of those arrangements. If we are forced to cancel your tripafter departure we will, wherever possible, make suitable alternative arrangements. If we are unable to make such alternative arrangements, or you reject these for good reason then we will return you to your point of departure and refund you for any unused services, if appropriate.
Circumstances amounting to “force majeure” include any event which we or the supplier of the service(s) in question could not even with all due care, foresee or forestall such as (by way of example and not by way of limitation) war, threat of war, riot, civil strife, industrial dispute, actual or threatened terrorist activity, natural or nuclear disaster, fire, acts of God, unavoidable and unforeseeable technical problems with transport for reasons beyond our control or that of our suppliers, closed or congested airports or ports, hurricanes and other actual or potential adverse weather conditions, flood, epidemics, health risks or pandemics illness and all similar events.
Each trip begins and ends in a town accessible by plane, train, boat or bus. Meeting and ending locations are listed on each of the individual trip pages on the website, as well as in your pre-departure information. For some tours, it may be preferable to arrive at the starting point the night prior to the trip departure date.
Trip prices are based on two people per room. If you are traveling alone, you can choose to room alone, paying the single supplement. There are a limited number of single rooms available on all trips. Upon request, we may also be able to match you with another solo traveller who is interested in sharing a room.
Adequate and valid travel insurance is mandatory for all clients while on one of our tours. You are strongly advised to insure yourself against any possible risk that may occur and in particular to ensure that you have sufficient insurance in respect of dependent relatives. You are required to carry proof of insurance with you and produce it if reasonably requested by company employees or suppliers.
You are responsible for ensuring that you are in possession of travel insurance for the entire duration of the tour in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment, with adequate cover/benefits against any possible risk that may occur and you must ensure that there are no exclusion clauses which limit cover for the type of activities included, or the altitudes attained, in your tour
You must advise us of the details of your insurance including the name of the insurer and the policy number as soon as possible. If you fail to provide us with the details of your insurance, we reserve the right to refuse travel and any cannot guarantee the refund of any pre-paid funds. In the event that you fail to provide us with the correct details of your insurance as soon as possible or at all, you will be liable to us for any loss we incur as a result of your breach of this condition and any such costs will be redeemable from you.
Whilst we are able to provide basic advice to clients regarding passports and visa requirements, you should check with the appropriate Embassy, Consulate or Foreign Office for the exact requirements for your chosen tour and date of travel. It is your responsibility to ensure that you have the correct passport and visas to gain access to any country/region included in the travel arrangements which you purchase from us. If you fail to do so, we have no liability to you for any cost, loss or damage which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements. In some cases, countries will refuse entry to clients who have criminal records. Should you be concerned about this, please check with the embassy or consulate of the countries to which you are travelling. The lead name is entirely responsible for ensuring that all members of the group have the correct and valid documentation for travel. We cannot accept responsibility for any failure to comply resulting in any costs or fines being incurred and we advise you to check with your passport office or the consulate in question if you have any queries. Guest travelling overland to certain destinations may need to also pass through controls of other countries en-route so this should be allowed for with any passport/visa applications.
It is your responsibility to familiarise yourself with, and respect local laws and customs. If you fail to do so, we will have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.
You are responsible for choosing a trip that fits your abilities, level of fitness and health. All guests are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen holiday as described in the itinerary. For the majority of our trips the minimum age is 18 at the time of travel. No unaccompanied minors (those under 18 years of age) can be accepted however minors aged between 3 and 17 years maybe accepted on some trips (eg Private Experiences) providing they are accompanied by a legal guardian who accepts full responsibility for them. Anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the holiday. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the holiday in which case all monies paid will be forfeit.
We are able to advise on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements, recommendations for your destination and any costs. Where you do not do so and either are not allowed to enter any country, or suffer personal injury or death as a result, we have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements. Clients with existing medical problems, pregnant women and anyone who has recently visited other countries should check requirements with their general practitioner.
Mistral Experiences reserves the right and trip participants agree to allow Mistral Experiences to take photographic or film records of any of our trips and trip participants, and may use any such records for promotional and/or commercial purposes. Any likeness or image of you secured or taken on any of our experiences may be used by Mistral Experiences without charge in all media (whether now existing or in the future invented) for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind such as brochures, slides, video shows or the internet. Any written feedback supplied to the company may also be used for promotional purposes as detailed above.
